1. Spotlark is a booking facilitator, not a party to the parking arrangement

Spotlark provides a platform that connects space owners ("Owners") with drivers ("Parkers") and processes payment for short-term use of a parking space. Spotlark does not own, operate, inspect, or insure any parking space listed on the platform, and is not a party to the arrangement between an Owner and a Parker.

2. Use at your own risk

Both property owners and vehicle owners use Spotlark's services entirely at their own risk. Owners are responsible for the condition, legality, and safety of the space they list. Parkers are responsible for their own vehicle, its contents, and safe operation while accessing, parking in, and leaving a space. Spotlark is not responsible for damage, theft, injury, towing, parking citations, or any other loss arising from the use of a listed space.

3. Space size & availability

Spaces are listed as standard 9 ft × 18 ft parking spaces unless otherwise noted. Owners are responsible for keeping listed availability hours and space counts accurate. Spotlark assigns a specific numbered space automatically based on the availability an Owner has provided; Spotlark does not guarantee physical access if an Owner's information is inaccurate or a space is otherwise unavailable.

4. Payments

Credit card and Apple Pay payments are processed through Stripe.

5. Owner payouts

Card and Apple Pay payments are split automatically through Stripe Connect: the Owner receives 90% of the booking total directly to their connected Stripe account, and Spotlark retains a 10% platform fee. Owners must complete Stripe's account setup before their listings can accept card payments.

6. Cancellations

Bookings cancelled more than one hour before the scheduled start time are eligible for a refund; bookings cancelled within one hour of the start time are not refundable. When a refund is issued for a card payment, the Owner's 90% share is reclaimed and Spotlark's 10% fee is refunded as well, so the Parker is made whole. For cancellations made within 30 minutes of booking, Spotlark absorbs Stripe's non-refundable processing fee on the original charge rather than passing that cost on to the Owner.

7. Limitation of liability

To the fullest extent permitted by law, Spotlark disclaims all warranties and shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform or any parking arrangement made through it.
